General Terms and Conditions

Small House BV (“365Promax”; “the Company”; “we”; “our”) is a limited liability company, registered in Curaçao, part of the Dutch Caribbean. 365Promax® holds license number OGL/2023/159/0076, issued by the Curaçao Gaming Control Board (“GCB”). Registering on 365Promax (“the Website”) and clicking “I agree” means you, as a user (“you”; “your”; “user”; “player”), agree to be bound by our Terms of Service, Privacy Policy, Cookie Policy, and other applicable policies or rules for using this website (“the Terms”). Accordingly, you hereby enter into a legally binding agreement with us, and your use and access of our website indicate that you have read, understood, and agreed to be bound by our Terms.

1、Grant of License

• 1.1. Subject to the terms and conditions set forth herein, 365Promax grants the user a non-exclusive, personal, non-transferable right to use the service on a personal computer or other internet-accessible device to access gaming features.

• 1.2. The service is not available to individuals who: (i) are under 18 years of age; (ii) have not reached the legal age of majority in their jurisdiction; and (iii) access the service from a jurisdiction where such access is illegal. 365Promax cannot verify the legality of the service in every jurisdiction, and it is the user's responsibility to ensure their use of the service is legal.

• 1.3. 365Promax and its licensors are the sole holders of all rights to the service, code, structure, and organization, including copyright, trade secrets, intellectual property, and other rights. To the extent permitted by applicable law, you shall not: (a) copy, distribute, publish, reverse engineer, decompile, disassemble, modify, or translate the website; or (b) use the service in any manner prohibited by applicable laws or regulations (each of the above referred to as an “Unauthorized Use”). 365Promax reserves any and all rights not expressly granted to the user herein, and retains all rights, title, and interest in the service. You agree that you will be fully responsible for any damages, costs, or expenses arising from or related to any Unauthorized Use you perform. You shall immediately notify 365Promax upon becoming aware of any Unauthorized Use by any person and shall provide reasonable assistance to 365Promax in any investigation it conducts based on the information you provide.

• 1.4. The term “365Promax”, its domain names, and any other trademarks or service marks used by 365Promax as part of the service (hereinafter “Trademarks”) are exclusively owned by 365Promax. Furthermore, all content on the website, including but not limited to images, graphics, photos, animations, videos, music, audio, and text (hereinafter “Website Content”) belongs to 365Promax and is protected by copyright and/or other intellectual property or other rights. You hereby acknowledge that using the service does not constitute any rights for you to the Website Content and/or Trademarks or any part thereof. Under no circumstances may you use the Website Content and/or Trademarks without the prior written consent of 365Promax. Additionally, you agree not to engage in any act that damages or may damage the rights (including intellectual property rights) of 365Promax.

2、No Warranty

• 2.1. 365Promax makes no express or implied warranties regarding the service provided to you “as is,” and we provide no warranties or representations to you regarding its quality, suitability, completeness, or accuracy.

• 2.2. Regardless of any efforts made by 365Promax, 365Promax does not warrant that the service will be uninterrupted, timely, or error-free, or that defects will be corrected. Authority/Terms of Service You agree to the game rules on the 365Promax website.

3、365Promax reserves the right to publish, maintain, and close the service. Decisions made by 365Promax management regarding any service use or dispute resolution are final and not subject to review or appeal.

4、Your Obligations as a Player

4.1. You hereby declare and warrant:

• 4.1.1. You are at least 18 years old or have reached the higher legal age of majority in your jurisdiction of residence (e.g., Estonia - 21 years old), and you are entitled to participate in the games offered on this website under the laws applicable to you.

• 4.1.2. You participate in games solely for personal, non-professional purposes, for leisure and entertainment only.

• 4.1.3. You participate in games on your own behalf and not on behalf of any other person.

• 4.1.4. All information you provide to 365Promax during the term of this agreement is true, complete, and correct, and you will immediately notify 365Promax of any changes to such information.

• 4.1.5. You are solely responsible for declaring and paying any taxes applicable to you on any bonuses received from 365Promax according to relevant laws.

• 4.1.6. You understand that participating in games involves the risk of losing virtual funds deposited into your member account.

• 4.1.7. You or a third party shall not engage in any fraudulent, collusive, manipulative, or other illegal activities when participating in any game, nor use any software-assisted methods, techniques, or hardware devices to participate in any game. If such behavior occurs, 365Promax reserves the right to cancel any bets.

• 4.1.8. You understand that virtual funds like Bitcoin are not considered legal tender or bids, therefore on the website, they are treated as virtual funds with no intrinsic value.

• 4.1.9. You understand that the value of Bitcoin may fluctuate significantly based on market value.

• 4.1.10. You shall not use any payment method owned by a third party or another person.

4.2. You may not transfer, sell, and/or acquire user accounts. 4.3. The way to play games on our website should be the same as playing in any other environment. This means players should be polite to each other and avoid making rude or obscene comments. 4.4. In some cases, bet confirmations or erroneous payments by us may occur. In all such cases, 365Promax reserves the right to cancel all accepted bets containing such errors. 4.5. If a user becomes aware of a potential error or incompleteness in the software, he/she agrees not to exploit such error or incompleteness. Furthermore, you agree to report any errors or incompleteness immediately to 365Promax. If you fail to fulfill the obligations stipulated in this clause, 365Promax is entitled to full compensation for all costs related to the error/incompleteness, including costs related to the respective error/incompleteness and any costs arising from your failure to notify. 4.6. If a game has started but fails due to a system failure, 365Promax shall refund the amount bet in the game to the user by crediting the amount to the user's account; if the account no longer exists, pay it to the user in an approved manner; if the user had accumulated credits at the time of the game failure, credit the monetary value of the credit amount to the user's account; if the account no longer exists, pay it to the user in an approved manner. 4.7. 365Promax reserves the right to refuse or limit bets. Users may not bet more than the amount in their personal account. Winnings will be credited to the user's personal account. 4.8. If there is suspicion or evidence of manipulation of the casino system, 365Promax reserves the right to withhold payment. Any user or any other person who manipulates or attempts to manipulate the casino system will face criminal charges. 365Promax reserves the right to terminate and/or change any game or activity offered on the website. 4.9. We reserve the right to request verification upon the occurrence of suspicious or fraudulent transactions.

4.10. 365Promax reserves the right to declare a bet partially or wholly void if it solely determines that any of the following circumstances are evidently present:

• 4.10.1. You or a person related to you may directly or indirectly influence the outcome of an event to obtain an illegal benefit.

• 4.10.2. You or a person related to you directly or indirectly circumvent the rules of 365Promax.

• 4.10.3. The event outcome is directly or indirectly affected by criminal activity.

• 4.10.4. The bet would not have been accepted but was accepted during a period when the website was affected by technical problems.

• 4.10.5. The bet was offered, placed, and/or accepted due to an error such as a misprint, technical error, force majeure, or other reason.

• 4.10.6. If a player's deposit fee is too low and is flagged by the blockchain or similar as "insufficient fee to relay," 365Promax reserves the right to confiscate winnings if 365Promax solely decides that the player's transactions and behavior are of a fraudulent nature.

• 4.11. If you have entered into a self-exclusion agreement with any gambling provider, you must immediately notify 365Promax.

5、Prohibited Use 5.1. Personal Use. The service is for your personal use only. You may only place bets for personal entertainment purposes and shall not create multiple accounts, including for collusion and/or abuse of the service. 5.2. Jurisdictions. Individuals located or residing in Aruba, Bonaire, Curaçao, France, the Netherlands, Saba, Statia, St. Maarten, and the United States (“Prohibited Jurisdictions”) may not use the service. For clarity, these restrictions on participating in real-money games also apply to residents and citizens of other countries located within a Prohibited Jurisdiction. Any attempt to circumvent these restrictions, including manipulating the information 365Promax uses to identify your location or providing false or misleading information about your location or residence, constitutes a breach of this agreement.

6、Know Your Customer (“KYC”) 365Promax reserves the right to request users to provide any necessary KYC documents to verify their identity and location at any time. Services and payments may be restricted until your identity is fully verified

7、Breach

• 7.1. Without prejudice to any other rights, if you breach any term of this agreement, whether in whole or in part, 365Promax reserves the right to take appropriate action, including terminating this agreement or any other agreement with you, and/or taking legal action.

• 7.2. You agree to fully indemnify, defend, and hold harmless 365Promax, its shareholders, directors, agents, and employees from all claims, demands, liabilities, damages, losses, costs, and expenses (including attorney's fees) arising from your breach of this agreement, violation of any law or third-party rights, or your use of the service.

8、Limitations and Liability

• 8.1. In no event, including negligence, shall 365Promax be liable for any direct, indirect, special, incidental, or consequential damages (including loss of business profits, business interruption, or loss of business information) arising from the use or misuse of the service, even if 365Promax has been advised of the possibility of such damages.

• 8.2. This agreement does not exclude or limit 365Promax's liability for death or personal injury caused by its negligence.

9、Disputes If you wish to complain, please contact 365Promax's customer service team: XXXXXX. If a dispute is not resolved satisfactorily, you may seek relief within the jurisdiction under the applicable law below.

10、Amendments 365Promax reserves the right to update or modify this agreement or any part thereof, or change the service, at any time without notice. Such amendments are binding upon you once published. Therefore, we advise you to review the current terms and conditions periodically. Continued use of the service signifies your acceptance of any amendments.

11、 Governing Law This agreement and any related matters are governed by the laws of Curaçao. You irrevocably agree that the courts of Curaçao have exclusive jurisdiction over any claim, dispute, or difference arising from this agreement. You irrevocably waive any right to object to an action being brought in the courts of Curaçao, to claim that such action has been brought in an inconvenient forum, or to challenge the jurisdiction of the courts of Curaçao. This clause does not limit 365Promax's right to bring proceedings against you in any other jurisdiction with competence, nor does it preclude the simultaneous conduct of proceedings in multiple jurisdictions as permitted by the laws of such jurisdictions. If any term of this agreement is or becomes illegal, invalid, or unenforceable in any jurisdiction, it shall not affect the validity or enforceability of any other term of this agreement in that jurisdiction, nor the validity or enforceability of that term or any other term of this agreement in other jurisdictions.

12、 Assignment 365Promax reserves the right to assign this agreement in whole or in part at any time, without prior notice. You may not assign any of your rights or obligations under this agreement.

13.、Advantage Play

If 365Promax discovers any user accepting a bonus or promotion with the intent to unfairly exploit winnings and secure guaranteed profits, the bonus will be immediately forfeited and the account closed. 365Promax reserves the right to refuse further withdrawals. Examples of advantageous gaming include delaying game rounds until wagering requirements are met or making new deposits while free spins or bonus features are available. Placing even, zero, or low stake bets, or hedging bets, are considered illegal gaming to meet bonus wagering requirements. If illegal gaming is discovered, 365Promax reserves the right to refuse any withdrawals and confiscate all winnings.
